Terms & Conditions

It should be understood and agreed that these Terms & Conditions form part of the contract agreement between the first party, hereafter called ‘the Videographer' or ‘Showcase Media Productions' and the second party i.e. the person/persons booking the video service, hereafter called ‘the Client'. It is also agreed that both parties will make no subsequent changes or modifications to the contract without agreement in writing.

1. Price, Deposit & Expenses

1.1 The price for the services includes preparation prior to the event, recording of the event, editing and producing the finished DVD and presenting to the client the number of copies specified on the booking form. An additional charge will be payable for each extra copy of the finished DVD.

1.2 A deposit shall be payable by the client on booking. The deposit shall be no less than 25% of the total service agreed, unless set out otherwise. Because of the difficulty in obtaining replacement bookings this deposit will be non-refundable if the client cancels or purports to cancel the booking.

1.3 All travel and accommodation expenses will be paid on the day of the shoot.

1.4 A futher 25% of the total service agreed is to be paid on the day of the shoot and the balance is payable on completion of the project.

2. The Videogarapher's Rights

2.1 The Videographer shall: Have full artistic license in regard to filming, editing and production etc. as applicable.

2.2 In the event of equipment failure, accident, or illness, vehicle or mechanical breakdown, then the videographer is limited to a refund of the monies paid.

2.3 Showcase Media Productions will require confirmation that permission has been granted by an authorized person at the event venue to film and that any such fee's or costs associated with permission shall bet met in full by the client. It must be noted that in some circumstances restrictions may be placed on filming in some venues and that the videographer for this reason cannot be held responsible for circumstances that may limit video coverage.

2.4 It is the responsibility of the person/persons booking the video service to ensure that any copyright or MCPS fees / requirements have been addressed in full.

2.5 Any additional material to be inserted into the final production i.e. photo's or names for the final credits will be provided prior to shooting so as not to incur a delay in the final product.

2.6 Showcase Media Productions use the DVD-R format when writing to the DVD media as this is the most compatible standard and works on 95% of DVD players, however we will not be responsible for DVD's not working in some DVD players this is because not all DVD players are compatible with current standards.

2.7 Showcase Media will not be held responsible for poor lighting / audio conditions or any situations beyond our control that may effect the final production.

3. Intellectual Property

3.1 All intellectual property belongs to the videographer. The master tapes remains the property of the videographer and the copyright thereof belongs to Showcase Media Productions.

3.2 Showcase Media Productions may make reasonable use of some parts of the finished production to use as display or advertising purposes. The client must advise Showcase Media Productions in writing at the time of completion if they object to this.

3.3 Showcase Media Productions reserves the right to display a company tag on any finished product. The client must advise Showcase Media Productions in writing at the time of completion if they object to this.

4. Client Rights

4.1 Once presented with the finished DVD the client owns the right to show or copy the recording for promotional or re-sale purposes.

4.2 The Videographer accepts no liability for any loss or damage caused to or by the DVD to the client or associates DVD players.

4.3 Your statutory rights are not affected by these conditions.

5. Standards and Exclusions

5.1 The Videographer shall: At all times strive to maintain the highest standard of workmanship and artistic ability of work within the reasonable terms set out by the client or by any official or person possessing the correct and legal authority to set limitations or restrictions.

5.2 The Videographer shall: not be responsible for non-fulfilment of the contract if restricted by unreasonable limitations.

5.3 The Videographer will: carry out assignments with all proper respect and decorum for the environment and surroundings, causing the minimum distraction and disturbance necessary to achieve a satisfactory recording;

5.4 The Videographer shall: comply with the standard of dress and conduct appropriate to the occasion to which they are working.

5.6 The Videographer will endeavor a pleasing colour balance, but cannot guarantee exact colour matching as seen by the human eye, due to lighting conditions at the venue and other variables beyond the Videographer's control.

6 Cancellation

6.1 The contract is subject to alteration or cancellation by the Videographer if the production is subjected to any cause or non-compliance or failure beyond control.

6.2 In the unlikely event of a videographic failure or cancellation of the contract by the Videographer any liability to the client will be restricted to a full refund of all monies paid.

6.3 The Videographer will not be liable for any consequential loss howsoever caused.

6.4 The client may cancel the contract only in writing on any date prior to the Event. Cancellation will result in the loss of any deposits paid.
